Transport Department - Driving Improvement Course

		Background
		In order to enhance the awareness of road safety and foster good driving behaviour, Driving Improvement Course (DIC) has been introduced since September 2002. It is an 8-hour course which covers topics of driving-offence points system, concept of safe driving and prevention of traffic accidents, legal provision on drink and drug driving, good driving manner, etc. In order to encourage drivers to attend the DIC, 3 driving-offence points ("DOP") will be deducted from the total number of points the participants have incurred on the date he/she has completed the course and assignments with satisfactory performance. However, no DOP can be deducted if on the date the person completes a driving improvement course in relation to which he/she is issued with a course certificate – (i) has not incurred any DOPs; or (ii) has already incurred 15 or more DOPs; or (iii) the Commissioner for Transport has within the past 2 years deducted DOPs for completion of a driving improvement course in relation to which he/she is issued with a course certificate from the total number of DOPs incurred by the person.
		Mandatory Attendance of the Course
		As a measure to further enhance road safety, persons falling within the following categories shall be required to attend the driving improvement course on a mandatory basis within a specific period of time starting from 9 February 2009: (a) persons convicted of any one of the following serious traffic offences under the Road Traffic Ordinance (Chapter 374): - causing death by dangerous driving (section 36) - causing grievous bodily harm by dangerous driving (section 36A) - dangerous driving (section 37) - drink driving offences (sections 39, 39A, 39B and 39C) - drug driving offences (sections 39J, 39K, 39L, 39O(1) and 39S) - driving in excess of speed limit by more than 45 km/h (section 41); or - motor racing and speed trials (section 55) (b) repeated traffic offenders who have accumulated 10 or more Driving-offence Points (DOPs) in respect of offences that are committed during a period of two years. Traffic offenders will be required to attend the Course within three months from the date of issue of the written notification issued by the Transport Department for every 10 DOPs incurred.
		Court Order/ Transport Department's Written Notification to Attend the Course
		Generally, traffic offenders will be required to attend the Course within three months from the date of issue of the written notification issued by the Transport Department, or according to the period ordered by the court.
		Consequence of Non-compliance with Mandatory Attendance of the Course
		Traffic offender who does not comply with the court order or the written notification from the Transport Department to attend the Course may be liable to a maximum fine of $10,000 and imprisonment for a maximum period of two months, and he is still required to attend the Course. The Transport Department shall refuse to issue, re-issue or renew a driving licence of an offender who fails to abide by the order or notification. If the traffic offender is ordered compulsory attendance of the Course and disqualified by the court from holding a driving licence at the same time, the Transport Department will return the driving licence to the offender only after he has completed the Course and the lapse of the disqualification period.
