Statutory Requirements

(1) Requirements on Placing of Mobile Telecommunications Devices (MTDs)

The quantity, size and position of MTDs (i.e. mobile phones, tablet computers or laptop computers) placed in front of the drivers while driving are regulated.

Quantity: No more than two devices


Size: Diagonal length of each device's screen visible to driver not exceeding 19cm

The legislation regulates any MTD that is placed forward of the driver's seat (i.e. the compartment space forward of the driver's seat, including windshield, dashboard or other locations that a MTD can be placed) and a screen of the MTD is visible to the driver, but excluding the MTDs being used by passengers only.

In addition, the devices must not obstruct the driver's view of the following:

(2) Requirements on the Use of MTDs or Regulated Telecommunications Equipment

If the motor vehicle is in motion, the driver is prohibited from using a MTD while holding in hand or between his head and shoulder, or using any regulated telecommunications equipment while holding in hand. Moreover, the use of any accessory to the device/ equipment while holding in hand is prohibited.

Offence

Any driver who contravenes the requirements above without reasonable excuse is liable to a maximum fine of Level 1 (currently $2,000).
