DISCOVERY BAY TUNNEL LINK ORDINANCE (Chapter 520)
(Notice under section 23)
SPECIFICATION OF VEHICLES
Pursuant to section 23(1) and (2) of the Discovery Bay Tunnel Link Ordinance, Chapter 520, I hereby determine that with effect from 10.00 a.m. on 26 October 2014, the Discovery Bay Tunnel Link may be used for the passage of the following classes and description of vehicles:—
(a) Public buses engaged in the provision of:—
(i) residents’ service as defined under section 4(3)(f) of the Public Bus Services Ordinance (Chapter 230) to serve the residential developments in Discovery Bay; or
(ii) student service as defined under section 4(3)(d) of the Public Bus Services Ordinance (Chapter 230) for students residing or studying in Discovery Bay; or
(iii) service for the carriage to and from Discovery Bay of persons with disability and of persons assisting them; or
(iv) tour service as defined under section 4(3)(a) of the Public Bus Services Ordinance (Chapter 230) for the carriage to and from Discovery Bay of tourists; or
(v) hotel service as defined under section 4(3)(c) of the Public Bus Services Ordinance (Chapter 230) for the carriage to and from the hotel in Discovery Bay of any resident of the hotel; or
(vi) employees’ service as defined under section 4(3)(e) of the Public Bus Services Ordinance (Chapter 230) for the carriage to and from Discovery Bay of any person working in Discovery Bay; or
(vii) public bus service of a type approved by the Commissioner for Transport as referred to in section 27(4)(b) of the Road Traffic Ordinance (Chapter 374) for the carriage of passengers to and from Discovery Bay.
(b) Private buses engaged in the provision of:—
(i) student service as defined under section 27(5)(a) of the Road Traffic Ordinance (Chapter 374) for students residing or studying in Discovery Bay; or
(ii) disabled persons’ service as defined under section 27(5)(c) of the Road Traffic Ordinance (Chapter 374) for the carriage to and from Discovery Bay of persons with disability and of persons assisting them; or
(iii) any such service, not for hire or reward, approved by the Commissioner for Transport as defined under section 27(5)(d) of the Road Traffic Ordinance (Chapter 374) for the carriage of passengers to and from Discovery Bay.
(c) Private light buses as defined under section 2 of the Road Traffic Ordinance (Chapter 374) engaged in the provision of services for the carriage of passengers to and from Discovery Bay.
(d) Light, medium, heavy goods and articulated vehicles engaged in provision of services for—
(i) delivery of goods or servicing functions to and from Discovery Bay; or
(ii) maintenance, repair, cleaning, clearance, survey, inspection, construction, alteration or improvement of the Discovery Bay Tunnel Link or of the roads, utility, development or facility in Discovery Bay.
(e) Government vehicles on official duties.
(f) Ambulances or vehicles used by officers of the Fire Services Department, the Hong Kong Police Force, the Customs and Excise Department or the Correctional Services Department for official duties.
(g) Vehicles driven by the employees of the Discovery Bay Road Tunnel Company Limited for the purpose of journeys from home to office or vice versa.
(h) Vehicles owned by Discovery Bay Road Tunnel Company Limited and engaged in discharging duties in the tunnel area.
(i) Special purpose vehicles as defined under section 2 of the Road Traffic Ordinance (Chapter 374) and engaged in performing the designed special purpose in the tunnel area or in Discovery Bay.
(j) Taxis, other than New Territories taxis licensed for hire to carry passengers within the New Territories as specified in paragraph 1 of Schedule 7 to the Road Traffic (Registration and Licensing of Vehicles) Regulations (Chapter 374E).
This Gazette notice supersedes previous notice G.N. 3264 dated 27 May 2000 concerning notification of specification of classes of vehicles under the Discovery Bay Tunnel Link Ordinance (Cap. 520).
